This Privacy Policy explains how TMB processes your personal data. Where TMB relies on your consent for a particular activity including marketing communications, non-essential cookies, and any use of Event photographs or recordings TMB will request that consent separately and specifically at the point of collection. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal. Where TMB relies on a basis other than consent, the applicable basis is identified in Section 3.

2. INFORMATION WE COLLECT

2.1 Personal Information You Provide

When you register, book Services, or interact with the Platform, we collect:

  • 2.1.2 Booking and Event Information: – Event date, time, and duration – Venue address (street address, building name, apartment/villa number) – Number of guests (estimate) – Property type (apartment or villa) – NOC documentation (if uploaded)
  • 2.1.3 Payment Information: – Credit/debit card details (processed securely via third-party payment gateway; we do not store full card numbers) – Billing address – Transaction history – Wallet balance
  • 2.1.4 Communication Information: – Emails sent to or from TMB – Phone call recordings (for quality assurance, with your consent you will be notified at the start of the call and may decline). WhatsApp messages (if you contact us via WhatsApp Business).
  • 2.1.5 Feedback and Reviews: – Event ratings (1-5 stars) – Written reviews of Artists or Services – Post event survey responses – Customer support tickets and complaints
  • 2.1.6 Marketing Preferences: – Subscription to newsletters – Consent to promotional SMS – Social media interaction history (if you engage with our social pages).

2.2 Information Collected Automatically

When you access the Platform, we automatically collect certain information:

  • 2.2.1 Usage Information: – Pages viewed and features accessed – Time spent on the Platform – Click patterns and navigation paths – Search queries – Booking abandonment data.
  • 2.2.2 Location Information: – IP address-based general location (city/emirate level) – Precise geolocation (if you grant permission via device settings) – Venue location (from booking details)
  • 2.2.3 Cookies and Tracking Technologies: – Cookies (small text files stored on your device) – Web beacons and pixel tags – Local storage and session storage – Analytics tools (Google Analytics, Mixpanel,
    etc.)

2.3 Information from Third Parties

We may receive information about you from:
  • 2.3.1 Social Media Login: – If you register using Facebook, Google, or Apple login, we receive your name, email, profile photo, and public profile information (with your consent).
  • 2.3.2 Payment Processors: – Payment confirmation and transaction status from Stripe, Network International, or other gateways. – Fraud detection signals.
  • 2.3.3 Marketing Partners: – Campaign performance data from Google Ads, Meta Ads, etc.
  • 2.3.4 Artists: – Artists may provide information about Events.

2.4 TMB Event Content

  • 2.4.1 Video and Audio Recordings: – TMB does not record your Event by default. Where TMB wishes to capture photographs or footage for marketing purposes, TMB will request your consent in advance at the time of booking, and you may decline without affecting your booking. Where you consent, you remain responsible for informing your guests that recording will take place, and TMB crew will stop recording immediately on request from you or any guest. TMB will not capture or use images or audio of any identifiable person under 18 without the verified consent of a parent or guardian.
  • 2.4.2 Photos and Media: – Event photos captured by TMB crew for quality assurance and marketing. – Behind-the-scenes footage.
  • 2.4.3 User-Generated Content: – If you share photos/videos of your Event on social media and tag TMB, we may collect and repost such content (with attribution).

3. HOW WE USE YOUR INFORMATION

TMB processes personal data on the following bases. Contract necessity: account creation, booking processing, payment, Event coordination and customer support. Legal obligation: tax and VAT records, and responses to lawful requests from UAE authorities. Legitimate interests: fraud prevention, platform security, service improvement and analytics balanced against your rights and interests. Consent: marketing communications, non-essential cookies, precise geo location, and any use of Event photographs or recordings. Where processing relies on consent, you may withdraw it at any time.

3.1 Service Delivery

We use your information to:
  • 3.1.1 Process Bookings: – Confirm Artist availability – Schedule Events – Coordinate setup crew deployment – Send Booking Confirmations and NOC documents.
  • 3.1.2 Facilitate Communication: – Send transactional emails (confirmations, reminders, cancellation notices) – Conduct welcome calls for identity verification.
  • 3.1.3 Payment Processing: – Charge your credit card or debit card – Process refunds to your payment method or Wallet – Detect and prevent payment fraud.
  • 3.1.4 Event Coordination: – Share your Venue address and event details with Artists and contact number with TMB crew – Coordinate setup timing and logistics – Address any special requests.

3.2 Platform Improvement

We use your information to:
  • 3.2.1 Enhance User Experience: – Personalize Artist recommendations based on your preferences – Optimize Platform navigation and functionality.
  • 3.2.2 Analytics and Research: – Analyze booking patterns and trends – Identify popular Artist categories – Assess Platform performance (page load times, error rates) – Conduct market research and customer satisfaction surveys.
  • 3.2.3 Bug Fixing and Troubleshooting: – Diagnose technical issues – Monitor Platform uptime – Test new software releases.

3.3 Marketing and Promotion

With your consent, we use your information to:
  • 3.3.1 Direct Marketing: – Send promotional emails about new Artists, special offers, or upcoming features – Send SMS notifications for limited-time discounts – Retarget you with ads on Google, Facebook, Instagram, TikTok.
  • 3.3.2 Referral Programs: – Track referral codes and reward referrers – Notify you of referral bonuses.
  • 3.3.3 Content Creation: – Feature all kind of events content (with your consent) on our website and social media – Create case studies and testimonials (anonymized or with explicit permission).
  • 3.3.4 Loyalty Programs: – Administer Wallet credits, points, and loyalty tiers – Send birthday/anniversary reminders with special offers.

3.4 Safety and Security

We use your information to:
  • 3.4.1 Prevent Fraud: – Detect suspicious transactions – Verify identity through welcome calls – Monitor for chargebacks and payment disputes.
  • 3.4.2 Enforce Terms: – Investigate violations of Terms and Conditions – Suspend or terminate accounts engaging in prohibited conduct – Protect against harassment or misconduct.

4. HOW WE SHARE YOUR INFORMATION

4.1 With Artists

We share limited information with Artists to facilitate Service delivery:
  • 4.1.1 Information Shared: – Your first name, Event date, time, and duration, Venue address and property type, Number of guests and special requests.
  • 4.1.2 Artist Confidentiality: – Artists are contractually bound to keep your information confidential. Artists must not use your information for purposes beyond the booked Event. Violations may result in Artist suspension or termination

4.2 With Service Providers

We share information with third-party vendors who provide services on our behalf:
  • 4.2.1 Payment Processors: – Network International, or other PCI-DSS compliant gateways – Process credit/debit card transactions securely – Detect and prevent payment fraud
  • 4.2.2 Cloud Hosting Providers: – Amazon Web Services (AWS) – Store Platform data, databases, and backups – Ensure high availability and disaster recovery
  • 4.2.3 Email and Communication Platforms: – Mailchimp, – Send transactional and marketing emails – Manage email subscription lists
  • 4.2.4 Marketing and Advertising: – Facebook Ads, Google Ads, TikTok Ads – Deliver targeted advertisements – Track ad performance and conversions
  • 4.2.5 Background Check Providers: – For Artist verification (TrueMark process) – Conduct Emirates ID verification and residency checks
All service providers are bound by confidentiality agreements and are required to handle your data securely and in compliance with applicable laws.

4.3 For Legal and Safety Reasons

We may disclose your information when required by law or to protect our rights:
  • 4.3.1 Legal Compliance: – Respond to subpoenas, court orders, or legal processes – Comply with UAE Federal Tax Authority (VAT reporting) – Comply with data protection authorities or regulatory agencies.
  • 4.3.2 Safety and Security: – Protect against fraud, security threats, or illegal activity – Investigate violations of our Terms and Conditions – Enforce our rights in legal disputes.
  • 4.3.3 Emergency Situations: – Prevent imminent harm to persons or property – Respond to emergency requests from law enforcement.

4.4 Business Transfers

In the event of a merger, acquisition, sale of assets, or bankruptcy:

4.6 Anonymized and Aggregated Data

  • 4.6.2 Media and Researchers: – Providing statistics to journalists or academic researchers

5. DATA SECURITY

5.1 Security Measures

We implement industry-standard security measures to protect your information:
  • 5.1.1 TMB implements industry-standard security measures to protect Client data: – SSL encryption for data transmission – Secure servers with firewalls – PCI-DSS compliance for payment processing – Access controls limiting employee data access
  • 5.1.2 Despite these measures, no system is 100% secure and TMB cannot guarantee absolute security. Where a personal data breach occurs, TMB will notify the UAE Data Office and, where required, affected individuals, in accordance with clause 5.4.
  • 5.1.3 Client is responsible for maintaining the confidentiality of their account password.
  • 5.1.4 TMB collects Client personal data including: – Name, email address, phone number – Venue address for Event delivery – Payment information (processed securely via third-party gateway) – Event preferences and booking history – Ratings, reviews, and feedback.

5.2 Your Role in Security

  • 5.2.1 Password Protection: – Choose a strong, unique password (at least 8 characters, including letters, numbers, and symbols). – Do not share your password with anyone. – Use a password manager to store credentials securely.
  • 5.2.2 Device Security: – Keep your device’s operating system and apps up to date. – Enable device lock (PIN, fingerprint, face recognition). – Do not use public or unsecured Wi-Fi for financial transactions (use VPN if necessary).
  • 5.2.3 Phishing Awareness: – Be cautious of emails or messages claiming to be from TMB asking for your password or payment details. – Verify the sender’s email address (official TMB emails come from @themusicbrew.com domain). – Never click on suspicious links or download attachments from unknown sources.
  • 5.2.4 Report Security Issues: – If you suspect unauthorized access to your account, change your password immediately and contact us at support@themusicbrew.com

5.3 Limitations

  • 5.3.1 No Absolute Security: – Despite our best efforts, no security system is 100% impenetrable. Data transmission over the internet carries inherent risks. – We cannot guarantee that unauthorized parties will never gain access to your information.
  • 5.3.2 Third-Party Security: – We are not responsible for the security practices of third-party websites or services linked from our Platform. – If you click external links, review the third party’s privacy policy.
  • 5.3.3 User-Generated Breaches: – We are not liable for security breaches resulting from your own actions (e.g., sharing your password, falling for phishing scams).

5.4 Data Breach Notification

  • 5.4.1 Incident Response. In the event of a personal data breach affecting your personal information, TMB will:
    • a) investigate the breach promptly;
    • b) contain the incident and remediate the security vulnerability;
    • c) notify the UAE Data Office of the breach without undue delay after becoming aware of it, and within the period required by applicable UAE law and binding regulatory directions in force at the relevant time; and
    • d) notify you of the breach, without undue delay and within the period referred to in (c), where the breach is likely to prejudice your privacy, confidentiality or the security of your personal data, or where notification is otherwise required by applicable UAE law or by a direction of the UAE Data Office.
  • 5.4.1 A TMB does not adopt, and is not bound by, any notification period prescribed under a data protection regime that does not apply to it. TMB’s obligations in respect of personal data are governed by the UAE Personal Data Protection Law (Federal Decree-Law No. 45 of 2021), its Executive Regulations and any binding direction of the UAE Data Office, as in force at the relevant time. See clause 9.3.
  • 5.4.2 Notification Contents: – Nature of the breach (what data was compromised). – Steps we are taking to address it. – Recommendations for protecting yourself (e.g., changing passwords, monitoring accounts).
  • 5.4.3 Regulatory Reporting. TMB will report personal data breaches to the UAE Data Office, the federal data protection regulator established under Federal Decree-Law No. 44 of 2021, and to any other UAE authority to which reporting is required, in accordance with clause 5.4.1(c).
  • 5.4.4 Breaches involving an Artist. Where TMB discloses your personal data to an Artist for the purpose of performing a Booking, the Artist receives that data as an independent controller in their own right. Each Artist is contractually required to keep your data secure and to notify TMB promptly on becoming aware of any loss of, or unauthorized access to, it. Where TMB is notified of such an incident, TMB will treat it under this clause 5.4 and will notify you and the UAE Data Office on the same basis as a breach affecting TMB’s own systems.

6. YOUR PRIVACY RIGHTS

6.1 UAE Data Protection Rights

Under UAE data protection regulations, you have the following rights:
  • 6.1.1 Right to Access: – You may request a copy of the personal information we hold about you. – We will provide this information in a structured, commonly used, and machine-readable format (e.g., PDF, CSV).
  • 6.1.2 Right to Rectification: – You may request correction of inaccurate or incomplete personal information. – You can update most information directly via Platform settings.
  • 6.1.3 Right to Erasure: – You may request deletion of your personal information, subject to: – Legal retention requirements (e.g., financial records must be kept for 7 years for tax purposes). – Legitimate business needs (e.g., ongoing disputes, unpaid debts).
  • 6.1.4 Right to Restrict Processing: – You may request that we limit how we use your information in certain circumstances (e.g., while disputing accuracy of data).
  • 6.1.5 Right to Data Portability: – You may request that we transfer your data to another service provider (where technically feasible).
  • 6.1.6 Right to Object: – You may object to processing of your data for marketing purposes at any time (see Section 7.3). – You may object to processing based on legitimate interests (we will cease unless we have compelling grounds to continue).

  • 6.2.5 No Fee: – Requests are free of charge (unless manifestly unfounded or excessive, in which case we may charge a reasonable administrative fee).

6.3 Marketing Opt-Out

  • 6.3.4 Important Note: – Opting out of marketing communications does not affect transactional emails (Booking Confirmations, cancellation notices, security alerts).

6.4 Account Deletion

  • 6.4.1 How to Delete: – Email support@themusicbrew.com with “Delete My Account” in the subject line. – Or navigate to Platform settings > Account > Delete Account.
  • 6.4.2 What Happens: – Your account is deactivated immediately. – Personal information is anonymized or deleted within 30 days. – We retain certain data for legal compliance (financial records for 7 years for tax purposes).
  • 6.4.3 Cannot Be Undone: – Account deletion is permanent and cannot be reversed. – You will need to create a new account to use the Platform again.
  • 6.4.4 Outstanding Obligations: – You must cancel or fulfill all pending bookings before account deletion. – Any unpaid debts (e.g., damaged equipment) must be settled.

7. DATA RETENTION

7.1 Retention Periods

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.
  • 7.1.1 Active Accounts: – Account and booking data: for the duration of your account and for 3 years after your last activity, except where a longer period is required for tax and accounting records (see 7.1.2).
  • 7.1.2 Booking Records: – As required under the UAE Corporate Tax Law (7 years) and VAT record keeping rules (5 years).

TMB is not established in the DIFC or ADGM, and the separate data protection regimes of those financial free zones do not apply.
